I am chalking this up to another case that Florida as a state just blew (just like Casey Anthony). Rather than going for the charges that they could prove (manslaughter, gun charges), they went with murder 2 and didn't prove their case. Even the jury understood that, when they asked for clarification on manslaughter.
IMHO, George Zimmerman is just one of those crazy neighbors that just went too far. Wanna-be cop too unstable to be hired even as a security guard. Wanna-be MMA fighter that was losing a struggle with a high school pothead he confronted. So he pulls out the gun. His father is politically connected (hence no prosecution on those pesky molestation charges) so the local cops give him a pass until the dead kid's family makes a big stink. I will give it to the Martin family for keeping the heat on the state (a la
Emmett Till
).
I don't expect the furor to die down soon. We are about to have our 2nd weekend of protests here in Atlanta (as part of the 100-city nationwide plan). Last weekend, it was a smallish one in a public park. Saturday, there is a bigger one planned on the big Federal courthouse downtown. The goal being that "Stand Your Ground" needs to be struck down at the Federal level.
Personally, I dislike "Stand Your Ground" because it is too vague. In Florida, it has spurred a lot of vigilant crimes against innocent, unarmed victims in public spaces. It'll be interesting to see how the
Dunn case
is handled in September
when it is due for court
.
The rest of this is tl;dr for anyone interested in more detail on self-defense claims.
Florida passed "Stand Your Ground" in 2005 and it has just been a nightmare there. Georgia has a "Stand Your Ground" law (passed in 2007) but the state has not let anyone use it to get away with a crime committed in a public space.
Stand Your Ground - Georgia Style
.
Georgia already covered self-defense with other laws (self-defense in your home (burglary), defense of your property (car-jacking)). The "Castle Defense" law has been on the books since the late 1800's and covers self-defense in home invasions, our most common instances of self-defense. Recently, a lady was home alone with her kids and a guy broke in. She called 911 and then called her husband. Her husband told her to get the gun and retreat to the attic. She did, hiding in the closet that they had in the attic closet. Burglar opened the door to the closet and the lady shot him 5 times. Didn't kill him.
No charges for the shooting.
Burglar got 10 years.
The only case I've seen lately that even fits in with Zimmerman is
this one
. But since the shooter and the victim knew each other and there was money involved, it wasn't random.
